The lawsuit was filed on October 19, 2021 in the Southern district of New York. The woman claims that “Pop-Tarts are deceiving consumers, failing to warn them that strawberries are not it’s only fruit filling ingredient.”
This suit is trying to prove that Kellogs and their products specifically Strawberry PopTarts is dishonest as it is assumed that the main ingredient is strawberries when in reality it is not.
According to FDA regulations any kind of food that is sold to the public are not allowed to be labeled in a misleading way. The company Kellogs has avoided any q and a or press conference regarding this case as it is still ongoing.
